These Terms of Sale form an agreement ("Agreement") between you and Desert Blossom Candle Company, LLC for purchasing the items in your order. Please read these terms carefully. By submitting your order, you (1) agree to all of the terms of this Agreement, (2) consent to enter into this Agreement electronically, and (3) your click constitutes your electronic signature accepting this Agreement. If you do not agree to these terms, do not order products through our website.

Orders and Acceptance

By submitting an order, you confirm that all personal information entered is valid. Except for out-of-stock items, orders cannot be canceled or changed once submitted. Orders are subject to acceptance by us, and discrepancies should be notified immediately.

Lack of Availability

We strive to provide accurate inventory information. However, if an item becomes unavailable after your order is placed, we will cancel the order and notify you by phone, mail, or email. We reserve the right to cancel orders for out-of-stock items at any time.

Pricing

Prices on our website are in U.S. Dollars and do not include shipping or handling, which will be indicated at checkout. If a product is listed at an incorrect price, we reserve the right to refuse or cancel any orders at the incorrect price, even if the order has been confirmed. If charged, a credit will be issued for the incorrect price.

Promotional Code Rules & Restrictions

Promotional terms may change, and specific details will be shown with the promotion code. Review the code's details when redeeming any promotional offer.

Prohibition on Resale

Products are for personal use only, and resale to third parties is prohibited. We reserve the right to cancel orders or refuse sales exceeding $500 in total, including multiple transactions.

Shipment and Delivery

Shipments will be made via a carrier of our choice, or the method you select at checkout. Additional charges apply for express delivery. We aim to ship within the indicated time, but dates are estimates and not guaranteed. We are not liable for carrier delays. Risk and title to items pass upon delivery to the carrier.

Returns

Returns are not accepted. If issues arise with your order, please contact us for replacement options, if available.

You agree to indemnify and hold harmless Desert Blossom Candle Company, LLC and its employees, directors, officers, and agents from any and all claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the products, violation of this Agreement, or any violation of law.

Limitation of Liability

We are not liable for incidental, special, punitive, or consequential damages arising from or connected with this Agreement or product use. Some states do not allow exclusions of such damages, so this limitation may not apply to you. Our liability for any claim is limited to the amount paid for the product. This does not apply in New Jersey.

Product Safety Disclaimer

You agree to use our products in accordance with all safety instructions provided and assume full responsibility for their use. Desert Blossom Candle Company, LLC is not responsible for accidents or injuries arising from improper use of the products.

Force Majeure

Desert Blossom Candle Company, LLC will not be liable for any failure or delay in performance under this Agreement caused by circumstances beyond our reasonable control, including but not limited to natural disasters, labor strikes, pandemics, or supply chain disruptions.

Electronic Communications

By visiting our website and placing an order, you consent to receive communications electronically. All communications are valid even if electronic, and you agree that electronic agreements satisfy legal writing requirements. If you need a paper copy of this Agreement, we will provide one upon request.

Terms of Use and Severability

Our services are subject to our Terms of Use. In case of conflict between these Terms of Sale and our Privacy Policy or Terms of Use, these Terms of Sale prevail. If any part of this Agreement is found illegal or unenforceable, the remainder remains in effect.

Choice of Law

This Agreement is governed by Arizona law, and jurisdiction is exclusive to courts located in Arizona. This provision does not apply in New Jersey.
